Terms of Service

This Terms of Service Agreement ("Agreement") sets forth the terms and conditions governing your use of our hosting services. By using our services, you agree to be bound by this Agreement. Please read it carefully before proceeding.
1. Definitions
1.1 "STEL Hosting LLC", "STEL Hosting", "we", "us", or "our" refers to the company providing the hosting services.
1.2 "Customer," "you," or "your" refers to the individual or entity using our services and agreeing to this Agreement.
1.3 "Services" or "Game" refers to the hosting services provided by STEL Hosting LLC.
2. Acceptance of Terms
2.1 By using our services, you acknowledge that you have read, understood, and agree to be bound by this Agreement.
2.2 If you do not agree with any provision of this Agreement, you may not use our services.
3. Refunds
3.1 STEL Hosting offers a 3-day refund policy for our game hosting services. If you are not satisfied with the service within the first three days, you may request a refund.
3.2 To request a refund, you must submit a written request to our customer support team within the refund period. Refunds are subject to our review and discretion.
4. Age Requirement
4.1 You must be at least 18 years old to use our services. If you are under 18 years old, you must obtain consent from your parent or guardian.
5. Payment and Billing
5.1 Payments for our services are subscription-based and due in advance for a 30 day period or by the due date listed on your invoice. Our payment processor will automatically attempt to charge your provided payment method on the due date listed on each invoice. If no forms of payment are provided or your payment method is removed, this action will fail and you will not be automatically charged. You are responsible for ensuring that subscriptions are properly cancelled through your payment gateway, such as PayPal, so that you do not get charged after your service is cancelled.
5.2 If payment is not received within 30 days or by the due date listed on your invoice, your service will be suspended for 3 days. After the 3 day suspension period, if payment is still not received, your service will be terminated and your data will be deleted permanently. The service may not be reactivated once it is terminated and the data cannot be recovered.
5.3 STEL Hosting reserves the right to change fees or prices for the services at any time at our own discretion. We will provide notice of any changes on our website or through other means of communication.
6. Account Creation and Information
6.1 You must provide accurate and complete information when creating an account with us.
6.2 You are responsible for maintaining the confidentiality of your account information, including your username and password. Any activities performed through your account will be your responsibility.
7. Prohibited Content
7.1 You agree not to host, upload, transmit, or distribute any content that is illegal, infringing, or violates any applicable laws or regulations.
8. Termination
8.1 STEL Hosting reserves the right to terminate your account and access to our services at any time, without prior notice, if you breach any provisions of this Agreement or for any reason subject to our discretion.
9. Limitation of Liability
9.1 STEL Hosting shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with this Agreement, including but not limited to loss of data, profits, or business interruption.
10. Fair Usage and Unmetered Policy
10.1 STEL Hosting provides free MySQL databases for your server under a "Fair Usage" policy. Under the "Fair Usage" policy, you may only store relevant game files. Excessive use, in the context of MySQL database storage and as defined by us, means any combined MySQL database that exceeds 10 GB of storage. You may not upload, transmit, or store other files to the provided MySQL database storages that are not being used, will be used, or been used by your game server. While MySQL databases for your server are not counted toward your storage allocation, we reserve the right to take the following actions if we deem that your storage usage is excessive:
10.2 (1) We may ask that you remove and discontinue the plugin(s) or mod(s) that are causing excessive storage usage.
10.3 (2) We may ask that you upgrade your plan with a higher storage capacity.
10.4 (3) We may transfer your MySQL databases to another remote server that possess the necessary storage space for you.
10.5 (4) We may cancel or suspend your service if the actions above do not adequately correct your excessive MySQL database storage usage.
10.6 STEL Hosting provides backup storage to all servers under an "Unmetered" policy. Under the "Unmetered" policy, every game server has 50 GB of storage that you may use to only store relevant game-related backup game files. Excessive use, in the context of backup storage and as defined by us, means any combined backups that exceeds 50 GB of storage. You may not upload, transmit, or store other files to the provided backup storages that are not being used, will be used, or been used by your game server. While backup storages for your server are not counted toward your storage allocaiton, we reserve the right to take the following actions if we deem that your storage usage is excessive:
10.7 (1) We may provide you with a courtesy upgrade to your backup storage soft-limit from 50 GB to an amount determined by us upon request.
10.8 (2) We may ask that you upgrade your plan with a higher storage capacity.
10.9 (3) We may ask that you delete backups that are causing excessive storage.
10.10 (4) We may cancel or suspend your service if the actions above do not adequately correct your excessive backup storage usage.
11. "AS IS" and "AS AVAILABLE" Disclaimer
11.1 Our services are provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding the availability, reliability, or suitability of the services for your specific purposes.
12. Governing Law
12.1 This Agreement shall be governed by and construed in accordance with the laws of Texas, United States. Any legal action or proceeding arising out of or in connection with this Agreement shall be brought in the courts of Texas.
13. Dispute Resolution
13.1 If you have any concerns or disputes regarding our services or this Agreement, we encourage you to contact us to attempt an informal resolution.
14. Changes to Terms and Conditions
14.1 STEL Hosting reserves the right to update or modify this Agreement at any time. We will notify you of any material changes by posting the updated Agreement on our website, through an e-mail notification, or through other means of communication. Your continued use of our services after the changes constitutes your acceptance of the revised Agreement.
